Terms & Conditions

Company Identity and Scope of Services

Sail Sea San Blas is a brand operated by Sea San Blas, a company registered in Panama. Sail Sea San Blas provides assisted booking and coordination services for crewed sailing experiences in the San Blas Islands (Guna Yala), Panama. Sail Sea San Blas does not own, operate, manage, or crew any vessels. All sailing trips are performed by independent third-party vessel owners and professional crews contracted for each experience. By accessing this website, submitting a booking request, or completing a reservation, you acknowledge that Sail Sea San Blas acts solely as a booking intermediary and coordination provider and agree to be bound by these Terms & Conditions.

Booking Process and Payment Obligations

All bookings are subject to availability confirmation with the selected vessel and crew.

Once availability is confirmed and pricing is agreed upon, full payment is required immediately to secure the reservation. No deposits are accepted.

Failure to complete payment within the stated timeframe may result in cancellation of the booking request without notice. Prices are listed in United States Dollars (USD). Depending on location, region, and payment provider availability, guests may be permitted to pay in their local currency. Accepted payment methods vary by region and may include major credit or debit cards, buy-now-pay-later programs, and certain digital or stablecoin payment methods. Prices displayed on the website or communicated via email, phone, or messaging platforms may change at any time prior to payment. Once availability is confirmed and full payment is completed, the agreed price is final and locked for that reservation.

Cancellations and Refunds

All cancellations, refunds, and refund eligibility are governed exclusively by the Refund Policy published at: https://sail.seasanblas.com/refund-policy. Refunds outside of the published policy are not guaranteed and may be considered only in extreme circumstances, at the sole and absolute discretion of Sail Sea San Blas. Approved refunds will be issued only to the original payment method used. No alternative refund methods will be provided.

Guests expressly acknowledge that local Guna Yala permits, community fees, and vendor costs are non-refundable once a booking is confirmed.

Weather, Routing, and Itinerary Adjustments

Sailing experiences in San Blas are inherently subject to weather conditions, sea state, safety considerations, operational constraints, and local authority permissions. Sail Sea San Blas does not guarantee specific routes, islands, anchorages, activities, departure times, or trip durations. Trips may be delayed, shortened, rerouted, or otherwise adjusted at any time for safety, weather, sea conditions, mechanical issues, or compliance with local regulations. Such changes do not constitute grounds for refunds beyond what is stated in the Refund Policy. Guests expressly accept that flexibility is an essential condition of sailing in San Blas.

Guna Yala Authority and Local Regulations

The San Blas Islands are governed by the Guna Yala indigenous authority. All guests are required to comply fully with local laws, customs, environmental regulations, and community rules. Local entry fees, navigation permits, and community charges are mandatory and non-refundable. Guests must follow all instructions issued by the captain and crew. Failure to comply may result in immediate removal from the trip without refund.

Health, Safety, and Assumption of Risk

Guests participate in sailing trips entirely at their own risk. Sail Sea San Blas assumes no liability for injury, illness, loss, damage, delay, or inconvenience unless caused directly by proven negligence on our part. Sail Sea San Blas is not responsible for vessel operation, navigation, onboard safety management, or crew conduct, which remain the responsibility of the contracted vessel owner and crew. Guests are solely responsible for their personal belongings. Sail Sea San Blas is not liable for loss, theft, or damage to personal items. Travel insurance is strongly recommended. Guests must disclose relevant medical conditions prior to booking. Pregnant guests may participate only during the first trimester and do so at their own discretion.

Conduct, Alcohol, and Authority Onboard

Alcohol consumption is permitted but must be moderate and responsible. Illegal drugs are strictly prohibited. On shared charters, guests are expected to behave respectfully toward crew, other guests, and local communities. The captain’s authority onboard is absolute. Any behavior deemed unsafe, disruptive, or inappropriate may result in removal from the vessel without refund.

Age, Fitness, and Suitability

There is no fixed minimum age requirement. Guest suitability is assessed on a case-by-case basis depending on vessel type and trip conditions.

Guests must be physically capable of safely boarding and moving around a sailing vessel.

Photography, Media, and Promotional Use

By participating in a Sail Sea San Blas sailing experience, guests grant Sail Sea San Blas unrestricted permission to use photographs and video recordings taken during the trip for marketing, promotional, and commercial purposes. This consent is irrevocable. Opt-out is not available.

Governing Law and Jurisdiction

These Terms & Conditions are governed by the laws of Panama. Any dispute arising from or relating to these terms, bookings, payments, or services may be brought before courts located in Panama, at the discretion of Sail Sea San Blas.

Modifications to Terms

Sail Sea San Blas reserves the right to modify these Terms & Conditions at any time without prior notice. The version in effect at the time of booking applies to that reservation.
